I, acting on behalf of myself and my participants, and to the extent allowed by the law, hereby waive and agree to release any claims of liability which myself, my participants, or the participant’s heirs and successors may have or believe to have against The Nature Classroom Inc., and its officers, employees, or agents for any injuries, losses, or damages to the participant’s personal property and my personal property. If I am hiring The Nature Classroom for a party or event, I am signing this waiver on behalf of all guests at the event. I knowingly and voluntarily enter into this waiver and release of liability and hereby waive any and all rights, claims or causes of action arising out of our participation in classes with The Nature Classroom Inc, and agree to the rules listed below:
RULES:
Children must remain with their caregiver at all times. The Nature Classroom staff are not responsible for participants.
Activities may involve small materials, and supplies that are not to be put in mouths or ingested for any reason. If participants like to put thing's in their mouths, please pay extra close attention to particpants to make sure this does not happen.
We do our best to use washable paints, dyes, and other materials. Some materials used may stain clothing or shoes.
We do our best to avoid high allergen materials, however The Nature Classroom is not considered allergy-free. Caregivers are responsible for monitoring allergies and sensitivities. The Nature Classroom is not responsible for allergic reactions.
Rough playing, throwing materials, and unsafe behavior is not permitted. Refunds will not be given for leaving class early.
If I am hiring The Nature Classroom for a party or event, I am responsible for all guests at the party, and am signing on their behalf.
By participating, you agree to the following rules and staff guidance.
I HEREBY release and forever discharge The Nature Classroom Inc., their affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns from any physical or psychological injury that I may suffer as a direct result of my participation in the classes. This release shall extend to and include the occupiers of land on which the activities or any part of it are conducted or which is involved directly or indirectly with the activities in any manner whatsoever.
This waiver applies regardless of whether I am participating in the classes at the time of the injury or whether my injury occurs as a result of my presence upon the premises regardless of purpose or activity at the time of the injury-causing incident. Participant agrees and covenants not to sue or otherwise attempt to hold The Nature Classroom liable for any injuries regardless of the cause.
Participant agrees to indemnify and hold The Nature Classroom harmless against any and all claims arising out of the participant’s presence upon the premises, including the use of the premises by any family member or guest of the participant regardless of cause.
This waiver and release agreement applies to all injuries including, but not limited to, slips and falls, harm caused by class materials, injury from natural wildlife, injury from any supplies and materials, injury from all class activities.
By signing this document, whether in written or electronic format, I understand that I may be found by a court of law to have forever waived, for me and my group I have registered, the right to maintain any action in court or to be decided by a jury against The Nature Classroom on the basis of any claim from which I have released The Nature Classroom and any released party herein and that I have assumed all risk of damage, loss, personal injury, or death to myself and/or my group and agreed to indemnify and hold harmless The Nature Classroom from and against any and all losses, liabilities, claims, obligations, costs, damages and/or expenses whatsoever paid, incurred and/or suffered by The Nature Classroom as a result of the participation in Activities in or about the Premises by myself or my participants, and/or claims asserted by myself or my participants against The Nature Classroom related to such participation in Activities.
I have had a reasonable and sufficient opportunity to read and understand this entire document and consult with legal counsel or have voluntarily waived my right to do so. I knowingly and voluntarily agree to be bound by all terms and conditions set forth herein.
